Terms of service

These terms are the agreement between you and [Business name, e.g. Your Name EI or PlainHire SAS] for using PlainHire. They're written to be read. The short version: you pay per hiring process, you make every hiring decision, and you're responsible for how you treat candidates.
1. Who we are
PlainHire (plainhire.app) is run by [Business name, e.g. Your Name EI or PlainHire SAS], registered in France (SIREN [number]), at [registered address, or a domiciliation address if you don't want your home address public]. Contact us at hello@plainhire.app.
“You” means the person who creates an account and, if you use PlainHire for an organisation, that organisation. By creating an account or paying, you agree to these terms, the privacy policy and, for candidates' data, the data processing agreement. You must be 18 or over, and able to agree on behalf of any organisation you name.
2. What PlainHire does
PlainHire helps you run a hiring process. Candidates email their CVs to an address for your role, or you upload them. PlainHire checks each application against the job-related criteria you write, shows the evidence it found, and helps you shortlist, reject and email candidates.
PlainHire supports your decisions; it doesn't make them. Assessments come from a decision model and a language model, and can be wrong or incomplete, for example if a CV describes something in an unusual way. You must review the evidence and make every decision about a candidate yourself. We don't guarantee any hiring outcome.
3. Your account
- You sign in with a link we email you, or with a password if you set one. Keep access to your email account secure, and turn on two-factor sign-in if you can.
- You're responsible for what happens under your account and for the team members you invite, and for giving them suitable permissions.
- Tell us straight away at hello@plainhire.app if you think someone else has accessed your account.
4. Prices and paying
- Hiring processes. You pay once for each hiring process you open, at the price shown when you pay (currently 20 in pounds, euros or dollars). A process stays open until you close it and includes 500 CVs.
- CV packs. If a process needs more, you can buy packs of 500 more CVs for that process. CVs that arrive once the allowance is used are kept, and scored when you add a pack.
- Tax. Prices include VAT or similar taxes where they apply. If you give a valid VAT number for a business outside France, we may not charge VAT (the reverse charge applies).
- Payment is taken by Stripe when you activate a process or buy a pack. We don't see or store your card details.
- Promo codes and referral credits reduce the price of a payment as described when you use them. They have no cash value, can't be exchanged or transferred, can't reduce a payment below a small minimum, and may have their own expiry dates and limits. We can withdraw codes, and cancel credits obtained by abuse (for example referring yourself).
- We may change prices for the future. A change never affects a process or pack you've already paid for.
5. Cancellation and refunds
If you're a consumer (not acting for a business), you normally have 14 days to cancel an online purchase. Because PlainHire is a service that starts as soon as you pay, we ask you to request that it starts straight away and to confirm that you understand you then lose the right to cancel. If you haven't done that, you can cancel within 14 days and we'll refund you, less a proportionate amount for anything already provided.
Our refund policy for everyone: if you activate a process or buy a pack by mistake and no CVs have been scored with it, email us within 14 days and we'll refund it in full. If PlainHire doesn't work as described and we can't fix it, we'll refund what you paid for the affected process. Refunds go back to the original payment method. Any promo code or referral credit used is returned to you.
Nothing in these terms affects your legal rights as a consumer.
6. Your responsibilities as an employer
For the candidates in your hiring processes, you are the controller of their personal data and we act on your behalf. You agree to:
- have a lawful basis for processing candidates' data, and complete a data protection impact assessment where required (we provide a template in your account);
- write criteria that are genuinely required for the job, and never use criteria, notes or decisions that discriminate on protected characteristics such as age, sex, race, religion or belief, disability, sexual orientation, pregnancy or marital status;
- review the evidence and make every decision about a candidate yourself, and not treat an assessment or ranking as a decision;
- tell candidates how their applications are handled (we give you the wording and send candidates a notice), and respond to their requests about their data within the legal time limits (we flag them for you);
- only put candidates' data into PlainHire for recruitment, and only send candidates emails that are accurate, lawful and not misleading;
- comply with employment, equality, data protection and other laws that apply to your hiring.
7. Acceptable use
Don't use PlainHire to break the law, send spam, collect data for anything other than recruiting, test or attack its security, overload it, copy or resell it, or try to extract its models or prompts. Don't upload files you don't have the right to share, or malware. We can suspend accounts that do.
8. Data
- How we handle your account data is in the privacy policy.
- How we handle candidates' data for you is in the data processing agreement, which forms part of these terms.
- Candidate data is deleted automatically a set time after a process closes (you choose the period). You can download everything, or delete any candidate, at any time before then.
- We may use anonymous, aggregated information (for example, how assessments compared with shortlisting decisions, with no text from CVs and nothing that identifies anyone) to measure and improve PlainHire.
9. Ownership
You own your content: your roles, criteria, notes and the documents you upload. You give us permission to use it only to provide PlainHire to you. We own PlainHire itself. If you send us feedback, we may use it without owing you anything.
10. Changes and availability
We work to keep PlainHire available and secure but can't promise it will never be interrupted. We may change or improve features. If we make a change that significantly reduces what you've paid for, we'll refund the affected process. We'll tell you about material changes to these terms by email at least 30 days before they apply to you.
11. Liability
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or anything else that can't legally be limited.
- If you use PlainHire for a business, we aren't liable for loss of profit, revenue, business or opportunity, or for indirect or consequential loss, and our total liability in any 12 months is limited to what you paid us in those 12 months.
- You're responsible for your hiring decisions and for your use of candidates' data, and you'll compensate us for claims caused by your breach of section 6 or 7.
- If you're a consumer, we're responsible for loss you suffer that was a foreseeable result of our breaking these terms or failing to use reasonable care.
12. Ending
You can stop using PlainHire at any time, and an owner can delete your organisation and all its data in Settings. We can suspend or close an account that seriously or repeatedly breaks these terms, and will normally warn you first. Sections 6, 8, 9 and 11 continue to apply after an account ends.
13. Law
These terms are governed by the law of France, and the courts of France have jurisdiction. If you're a consumer living elsewhere, you keep the protection of your local law and can bring a claim where you live.
If you're a consumer and we can't resolve a complaint together, you can refer it free of charge to our consumer mediator: [consumer mediator's name and website].
